After the 2018 farm bill, in some states, it MUST be within their sight for it to become probable cause. A smell alone is no longer enough.

I used to have long hair. I had a cop say that to me. I got pissed and shouted at him " NO YOU DON'T! I have not smoked weed in years!".

He was startled, took a step back, and wrote me a ticket for one of the tail lights.
