The full version of the judge yelling at Binger today

The context: In a pretrial hearing, the judge ruled that Binger could not raise statements Kyle made weeks before the shooting as proof of Kyle's propensity to want to shoot others (as Binger wanted to argue).

Kyle was with friends in a car and observing what looked like shoplifting going on in a CVS. Kyle said something like he wished he could shoot the shoplifters with his AR. He did not have his AR on him at the time. What Kyle did instead was call the police on the shoplifters.

Binger was trying to argue that Kyle's statement showed his propensity for wanting to shoot people for property crimes. The judge ruled that no, he could not bring up the CVS statement because it did not show propensity as far as his state of mind on August 25th was concerned.

Sneaky Binger tried to bring it up in court anyway (a huge no-no). Hence, the reason why the judge was so angry.

And that was just one of the times the judge lashed out at Binger today. The other time was when Binger was twice accused Kyle's silence (his 5th Amendment right) somehow alluded to guilt.

He's trying to get into the jury's heads the tarnishing implication that Kyle is lying by pointing out that his testimony is coming only after he's heard anything that could be used to catch him in a lie.

While this sounds reasonable to a normue unfamiliar with how insidious this actually is, it is in fact a form of misconduct that should get this prosecutor barred from lawyering (or practicing law in any capacity whatsoever).

He's getting the testimony of a witness to be disregarded in its entirety, this nullifying its consideration, and ability to be used to defend Kyle Rittenhouse in this case.

By doing this, he has completely justified a retrial on basis of misconduct with prejudice, a new jury, and a new prosecution, with the guarantee that the bias evident here will not be present.

At the very least, he needs a new jury who has not been witness to these proceedings, which is a very difficult thing to ask of anyone who is a us citizen at this point.

Well, otherwise, they could declare that he could not be fairly charged, and things could progress naturally from there.

In an ideal world, it would also get this prosecutor put behind bars for a long time.

He should be held in contempt, and removed from the trial proceedings, he's already crossed that line over and over again, why he's still not in jail is beyond me, and it's downright bizarre that this guy is not only not jailed for contempt, but still being permitted to prosecute in this case.

Aldo, a good point had been raised, that this prosecutor is a trained agitator, his manner and behavior is intended to produce an aggressive response or deeply unsettle the internal composure if anyone he is interacting with, this is able to be called out and admonished, and if continued in this way, he can be found to be acting in a belligerent manner, which is a cause for being found in contempt of court, but this has not been. Strange.

Yes, this might seem unreasonable for a mormie, but think of it this way, he is intentionally using his time in court to subject people to psychological abuse, with the interest of provoking a reaction that he could use against them, like an abuser does, as a lawyer, he knows of the proper manner in which to conduct himself which serves to allow for proceedings to go on in a fair and unbiased manner, and his cheeky smug little act of low-key trolling people is not excusable, it is certainly not able to be written off as unintentional, he could only be doing this intentionally, and if it were beyond his ability to control, he would not be permitted to be a prosecutor, in the same way sineone who is tone deaf could not be s singer and someone who is unable to move could not be a dancer.

I've seen the video, he said clearly, he wished he had his AR, I do not recall him at any point saying he wanted to shoot anybody. This is a largely baseless assumption Binger made, and then tried to pass off as fact.

Ah good point! I watched the pretrial hearing a while ago and I guess I was going by Binger's account. Clearly a mistake to do so!

It's a problem of this age, letting people with a record of pathological lying set the standard of initially assumed facts.

Like that news journalist who guessed that Harris and Klebold shot up columbine high in retaliation for being bullied, and it became the default assumption behind not just that event but the other school shootings that followed in that decade.

They keep lying, and we keep trusting them to be reliable sources of information.

I saw the full video. Anyone with any knowledge of first aid would realize it was time to render aid long before the cop got off. Not all cops are good cops. Murder was too strong but he certainly failed to render aid to someone in obvious medical distress. I wouldn't Chauvin to be the cop coming to my house in the night fox a vax check.
