This is potentially legal, normally any company that tried this would get "lol, I'm not paying you" as a response, however since they're holding your money they can just take it. Much in the same way a landlord could keep your security deposit for whatever made up reason, so long as it was in the contract you agreed to.
It could be considered fraud if it's retroactively applied to existing accounts, but it's very unlikely anyone will go to jail over it.
When they get sued over this they'll likely be forced to give the money back. Judges have quite a bit of leeway when it comes to this kind of non-sense thing slipped into a contract and will often void it.
It's not double jeopardy since it's a different incident. It is, however, vexatious litigation. Under Colorado law all that means is that if he wins he can recover attorney's fees. It's not actually a crime to engage in lawfare.
