Two thoughts:

1. There might be an argument for 1st degree - the nig put a knife in a bag (planning), he went to the other team's tent (premeditation), and he refused to leave when asked (deliberate).

2. The (((plan))) might be for the prosecution to fumble the case by pursuing a more severe charge that has a lower chance of sticking.

Texas doesn't actually have "first degree" and "second degree" per se. There's "murder", which can be premeditated or not, and there's "capital murder", which is usually premeditated but that's not a strict requirement. Both can get you life. Obviously the latter can get you executed. The only real difference between the charges is how psycho does the murder seem (i.e. does the DA really want you dead for what you did, or is it not worth the bother of a capital trial and just life without parole will do.)

From what I can tell, he's been charged with "murder", but because the indictment can be for premeditated and also can be punished with life in prison if convicted, most news outlets are reporting "first degree." But all a jury at the district court needs to return a verdict on is: if he killed Austin (which the nigger has already admitted to,) and if it wasn't self defense like he was asking the cops if maybe it could be (fucking lol.)

Should be a slam dunk, especially in that district. Even if the judge lets him plea down to aggravated assault and manslaughter, he could still do 40 years.

If going with first, it's all going to hinge on the fact that the nigger brought the knife with him. It's easy to argue "He brought a knife to school, one only brings a knife to school to stab someone". Combine that with his history, and there is a chance...

It's going to really come down to JURY SELECTION. If he gets OJ style selection (aka, bussing in a bunch of niggers from all around the actual area the crime took place in and stack the jury with like 8 of them), there's no way he's convicted.

I'm curious to see how this plays out.

I don't know the exact circumstances, or the State laws here specifically, but is there not some caveat that any murder committed during another crime becomes 1st degree/felony murder? Like a murder during a robbery, isn't it automatically a 1st degree murder charge? And wasn't this murder committed during a robbery (eg. A theft, where the victim of the theft is physically present)?

This was premeditated!!! You don't think he had a chance to decide yes or no on killing someone? No, he had this planned whether it was 5 minutes or 5 hours, it was still premeditated. His life was not in danger and had to make a life or death decision.

Perhaps they are able to prove/have good evidence that he came with the intent for robbery.
