The justices did not rule on whether the Alien Enemies Act, which the Trump administration invoked in mid-April to deport the detainees, had been applied correctly.

In a 7-2 decision, the court said the Trump administration had not given the detainees enough time or adequate resources to challenge their deportations.

Less than 24 hours following no knock type arrests.

Under these circumstances, notice roughly 24 hours before removal, devoid of information about how to exercise due process rights to contest that removal, surely does not pass muster,” the ruling said.

I don't misunderstand the ruling. But it isn't up to our institutions to mitigate the risk of illegally entering the country - specifically, the risks that accompany being caught and deported. You waive any notion of a right to due process, a right owed to citizens, when you B&E your way in. If it is known you're illegal, it should be a black bag on the spot and a one way trip across the border. Oh, you got separated from your kid? Maybe that will teach the others not to fucking do it.

I only commented on the SCOTUS decision re: 24 hrs notice (hence the complimentary breakfast comment). This timeline is totally arbitrary, and I don't think we owe due process to people who are not citizens, at least in the matter of deportation. Anytime. Anywhere. Gtfo.

Correct. Based on what I read, they ruled on the basis that the accused were not given sufficient time to prepare (i.e., they were given less than 24 hrs notice). I don't know what law that pertains to, but I think it's ridiculous, and SCOTUS didn't specify what the appropriate amount of time for adequate notice is.

We don't need the "Rule of law" subjected to the interpretations of who deserves it and who doesn't. EVERYONE gets due process. There has to be a check to ensure you're not punishing someone who didn't break the law. Just because the DoJ says that you're here illegally, doesn't make it true. The court ruled that there was not sufficient time given to the illegal aliens to answer the allegations that these people were gangs members of trans duh water and therfore "terrorists" subject to the act that authoritizes immediately deportation with limited due process.

If the federal government is going to call you a "terrorist" so that they can use a law written for terrorists to deport you with only a hearing, you have the right to be given a fair opportunity to deny that you're a gang member or a terrorist.

Alright, in the spirit of reasonableness and charity, I'll acknowledge that what you're saying is sensible on paper. But would you agree that in "war time" we lack the sheer capacity to give due process of this kind to highly suspect individuals (say, people who are clearly latinos, who bear identifying marks, who have criminal histories, etc.)?

Suppose we have 10 million illegal aliens in the country. Are our institutions prepared to facilitate this on time scales that are relevant for solving the problem, when all it takes is a single footstep to violate the law and weeks-to-months of trials with appeals (yada yada) to remove a single individual?

At some point, you have to recognize that the goods we have created are goods for a certain contingency. They can't be indefinitely extended or we're fucked. The founding fathers who talked about God-given, inalienable rights weren't anticipating the consequences of extending the bill of fucking rights to 10 million illegal aliens stealing tax revenues and exploiting the justice system to indefinitely extend their stay.

The irony here is that your founding fathers would have already been shooting guns at these federal employees while you try to defend the status quo.
