I'm kind of slow when it comes to legal stuff, but this seems to be a particularly interesting case unfolding.
Essentially, SCOTUS blocked the Trump administration's use of the Alien Enemies Act to deport Venezuelan gang members in a 1 am ruling. Now the Supreme Court rarely does this, I assume because they are old and sleep a lot and very rarely have any sense of urgency whatsoever.
Alito and Thomas were the only two dissenters. I have no idea why these Venezualans seem to be so valuable to so many branches of government. The Biden admin imported them and now the Supreme Court is bending over backwards to protect them, in a midnight decision right before a holiday Sunday. Anyone have a theory as to what's going on here?

“In sum, literally in the middle of the night, the Court issued unprecedented and legally questionable relief without giving the lower courts a chance to rule, without hearing from the opposing party, within eight hours of receiving the application, with dubious factual support for its order, and without providing any explanation for its order,” Alito wrote. “I refused to join the Court’s order because we had no good reason to think that, under the circumstances, issuing an order at midnight was necessary or appropriate. Both the Executive and the Judiciary have an obligation to follow the law.”

If he really wanted to, Trump could ignore all these judges and just get shit done. They're gonna screech all day anyways, might as well do what you want.
Interesting that he's basically saying the judiciary may not have followed the law here. And look law and common practice is that the lower courts must rule before The supreme Court rules. And that's really one of the things he's calling into question here
Also why is this particular immigrant population so seemingly valuable to everyone in government? Why does the Supreme Court care about these and not the thousands of other similar cases going through the courts right now?
I imagine there's some pretty significant political stuff behind the scenes that I don't understand.
Thank you for the explanation. So why do we think SCOTUS jumped the fence on this case in particular? Or am I being paranoid that there's something deeper.
I've expressed tinfoil hat theories that the Biden admin used significant cyberwarfare assets in Venezuela to create the material around Russiagate. I think you've explained before why we got a flood of these guys in that 350k of them were given TPS in 2021.
But so we're Haitians and Guatemalans and Lebanese, all kinds of other groups now being deported. Why the Court stepping in for this group of people right now, pulling themselves off of their underage concubines in the middle of the night to work no less?

The court even said that they were providing the decision because the ACLU filed for an emergency injunction and the president overstepped his bounds. Alito refused to side with the majority decision because it's in poor order, but agrees with the decision.

Alito seems to think that the 5th circuit would have ruled the same and would be the better court to get that particular ruling.
