Jefferson, like virtually the entire Southern planter class, would almost certainly have been a Confederate had he been alive in 1861. Even if Confederates bitched about him.

It is interesting though that much of the Virginia US officer corp remained loyal to the US. Including Winfield Scott himself, who was briefly commander of US forces.

Today's Supreme Court would consider tyrants to be a protected class under the civil rights act and permit the federal government the use of force to defend them.
