The thing is, even if a contractor successfully wins in court for not having to sign the pledge, they were already taken out of the labor pool and the amount of money that the employing firm would have to pay is a pittance compared to the black-balling they would get on contract bids. I know this is anecdotal faggotry on my part but the contractors I knew had to sign stuff like this long before states actually made this a law. They are given lists of companies that you are expected to avoid doing business with because they are not friendly to Israel. So not only are you forced to not boycott Israel, but you are forced to boycott those that Israel doesn't like.
Major contracting firms were already doing this before laws were passed. The laws were passed because state run institutions like universities were facing pressure to divest by student led boycotts. The laws were a reaction against an inability to stop a public outcry, even though the practice of squashing Israeli boycotts has long been instituted privately without official state backing.
