I had a really sick feeling on the legal fate of the old man in the aftermath of this shooting, since technically he was no longer in immediate danger as the burglars were fleeing, and he shot them in the back. And to add insult to injury, it is California after all.

But low and behold, after doing a quick search, it turns out the DA decided not to prosecute him, determining his actions were 'justified self-defense'.

One piece of human scum permanently removed from society (turns out she wasn't really pregnant), and the dude and his mother who was the lookout locked up in the pen. Just too bad he couldn't have fragged them all.

Looks like the prosecutor didn't like the optics of trying an 80 year old burglary victim. He knew that case would go down in flames.

Sometimes the good guys really do win after all.

Maybe, but I kinda doubt it. I think the prosecutor realized charging an 80 year old defending his home was a completely unwinnable case just based on the optics alone. I will concede if it had been a middle aged White guy or younger, he'd would've been dead meat.

Absolutely. I have no doubt that if this 80 year old White man was a young White man, or even a middle aged White man, they would have thrown the book at him, circumstances be damned.

The DA clearly thought this was a no-win case, so he dropped it like a hot potato.
