To my understanding, most states that recognize the castle doctrine will allow you to shoot over a carjacking but not if you happen upon your car being robbed. His vehicle being kicked probably won't justify a shooting if you ask a court.

This was my thought. In NYC, he would have been locked up and convicted 100% because we don't have "stand your ground." You have to be quite literally in a corner or a very, very cramped space to defend yourself, otherwise they will say that you had an opportunity to flee.

So castle doctrine in some states like Texas Missouri and Puerto Rico according to the AI answer includes your vehicles if you're occupying the vehicle and someone is attempting forcible entry with variations between those states and others. So since he was not occupying the vehicle it's probably not going to have a castle doctrine defense

However if the man told him as he approached him after having just committed violent action against his property if the man told him that he was going to kill him or any other words like that and the shooter may be the only person that knows then he would have a right to self-defense as my guess. Personally if I was on the jury and the man said or there was any evidence that the guy approaching him said he was going to kill him or doing bodily harm like kick his ass or anything else I would find the guy not guilty and reasonable self-defense. I've never believed that someone should have to suffer a beating and the chance of being permanently crippled or killed rather than killing the other person who is going to do it.
