Not only is that illegal without your permission, the only thing any prior employer can say about an employee is name, hire/last day date, position title, current salary and that's it. The reason why this is is because you can sue the prior manager for defamation if you don't get the job.
They let you know what they want and continuing the process is acceptance of the terms. they probably want to weed out anyone who won't accept their terms without question.
Even if someone was stupid enough to agree to this, the prior manager won't be. That is Manager 101. Never say shit that can get himself or the business sued. I would love to meet the streetshitter who wrote that.
Last managers ? Do they realize the conditions that have to be met for a previous manager to actually give a good review, and actually be around to give it?
Your job has to end on mutually acceptable terms for this to happen. And if you're actually a good employee, the conditions for it ending this way are hard to come by. (Their company founders, you have to move out of the region for reasons out of your control, that's about it). And even then, they actually have to be a nice guy and be willing to give up time for you. Lot's of bosses are total dickheads even if you were excellent.
Oh and how about the scenario where your previous job you worked at for 10 years and none of all your other great references from 10 years ago will answer an email anymore?
Basically they want to interview your previous bosses themselves and confirm you're a mutual job hopper.
