In Texas, it appears that brandishing a firearm is considered disorderly conduct. Texas Penal Code 42.01(8): "displays a firearm or other deadly weapon in a public place in a manner calculated to alarm."

From the looks of it, he could easily be charged with brandishing a firearm.

This. Even if it is reasonable to be able to articulate intent to a jury, remember that juryies are composed of libtard faggots. So even if the law is clear that you should be legally protected in your actions, if there is any kind of subjective element to the law like “what a reasonable person would do,” they will punish you for acting within the scope the law allows for having done anything with a gun.
