I am one of the biggest shitposters, ever, BUT I KNOW FREE SPEECH LAW for SCOTUS defined 'imminent lawless action'.

This man was sentenced for unrelated stuff becuase he oddly PLEADED GUILTY to :


both BOGUS, trvivial to win one day in appeal, or years later in supreme court

WEB POSTS IN OPEN FORUM do not count as cross-state 'telco era FCC threats'

FED ELECTED POLITICIANS and JUDGES, and probably FBI have magic free speech restrictions, but even Kathy Griffith got off scot free.

If he named EVERY member of a class, and not a subset of the class, such as "EVERY FED FUCKER" , then SCOTUS protects him. I think he was selective though.

If he made time period over 365 days, by omitting time or saying "eventually one day" he also gets off on very well defined SCOTUS rulings.... but they are using novel law on federal officials being more special than private citizens.


The US Supreme court ruled MANY MANY TIMES that to be illegal speech and a call to imminent violence or crime, an utterance needs TWO components :

1 > A SPECIFIC TARGET OR TARGETS not including a complete class of targets.

2 > AN IMMINENT TIME PERIOD LESS THAN 365 days from now.

BOTH criteria for illegal speech (plea for imminent lawless action) that any first year law student is taught:

So you can legally intra-state and across state borders type these words :

"All Jews should be shoved into ovens one day"

It lacks a subset, and lacks a date under 365 days from now.

But If you type :

"We should kill all the niggers next monday"

That too is legal speech because it lacks a subset of a class of targets, though does include imminent time.

Regarding the President, fed politicians, fed judges, that is one of 22 limits to free speech, but thousands of Democrats made calls for it in 2016, and ZERO were prosecuted claiming that the exemption for free speech would override the law protecting certain federal officials because of well re-stated SCOTUS rulings of not only Famous SCOTUS Brandenburg v. Ohio (1969), and SCOTUS Hess v. Indiana, 414 U.S. 105 (1973). For example, the (((public legal experts))) claimed that the thousands of Democrats threatening to kill the president, omitted a specific time, or were "mere puffery".

If you want a list of the 12 to 22 limits on free speech in USA, they are online , most in a wikipedia entry, and the rest in FCC interstate oriented laws on telephony threats, but SCOTUS allows passive internet postings not PERSONALLY constructed to be delivered to a threatened person, but mere public forum.

While it looks like some idiot blowing off steam, there actually are crazies who post threats and mean it. Also, why would the FBI not take offense at this? With the trump stuff and a threat that plausibly fits the description, 'fuck this guy'.

Keep 'violent rhetoric' at the opinion or belief level. "In my opinion, there should be an open season on them."
