Opponents of workplace diversity programs are using Section 1981 of the Civil Rights Act of 1866 to challenge equity policies and funding for minority-owned businesses.
The American Alliance for Equal Rights, led by conservative activist Edward Blum, is using Section 1981 to target the Fearless Fund, a venture capital fund supporting women of color-owned businesses. A federal appeals court has temporarily blocked funding for the Fund's grant program. Lawsuits invoking Section 1981 have been filed against companies such as Progressive and Pfizer, as conservative activists focus on workplace diversity following the Supreme Court's ruling on affirmative action.
