They can make whatever laws they want, even if it goes against the constitution (even when they know this is true). But, they're hoping to make as much money off of the dummies that don't know it's unconstitutional. They keep making money until somebody brings it up to the supreme court, which then declares "oh yeah, you can't do that, it's unconstitutional.
State lawmakers then go back and make a 'new' law. Rinse/repeat
