Like in Colorado if he appeals it then the order has a stay placed until a higher court rules for it. No higher court could rule for this.

This is lawfare, the goal is to make him waste time and money on appeals, all it does is energize his base and moderates and make the last semi self aware democrats cringe. When the unlawful orders get overruled they will demoralize dem voters because such desperation plays are clearly saying we can't win by voting so we must cheat so when we can't cheat why vote? Those who are looking for an excuse to check out of politics will abstain the vote believing he can't win.

They think it's a great idea to bog him down and harm his legitimacy but it legitimizes his claims and harms their voter turn out.
