The attorney that's suing you, or prosecuting you, isn't required to maintain an "innocent until proven guilty" position.
This is a civil case, so there is no "innocent until proven guilty" aspect, but even if there were, the prosecuting attorney is allowed to be convinced that the person he is prosecuting is guilty. Ffs, you'd think it would be required that the prosecutor believe that he was prosecuting a guilty person.
