Maybe it's a filter. Thereby you aren't really looking at human eyes and you have a sense of it. The fact that there is less image noise on the forehead than the checks makes me thing she touched up the photo.

Doesn’t this set a precedent in the circuit? Now if a guy gets caught with a 15yo girl and they try and through the book at him he can make a constitutional claim for unequal application of the law.

Because she was convicted its not going to help there, but you absolutely can make that claim for sentencing. It would help if there were fewer total cases though. Citing a specific other case for sentencing is more relevant when the courts see very few other cases so you can cherry pick cases that you think are similar in scale and the prosecution can do that too.

But a case like this where the courts see this once a week formalized guidelines exist. But you still might get away with bringing up this case and suggesting to go below guidelines to encourage courts to be more consistent but its ballsy. Lawyers might try it anyway.
