Meeting with an estate planning attorney next week

submitted by TheOriginal1Icemonkey to DebtFree 7 monthsSep 10, 2023 17:46:35 ago (+15/-0)     (DebtFree)

Recently realized that my current will lists properties and people who no longer exist, so time to get things rewritten. Now, in California, a will can be written on a napkin and as long as there are three witnesses to sign off on it, it is legal. However, what we need is a trust, because a will can be challenged by shitheads who want to get your stuff should you get croaked out for some reason. I for one have family I wish to not get anything I have and I have family and friends who I want to get my stuff, and there’s enough to worry about.
This is all part of building and maintaining wealth, witch all happens because of “debt free”

Nobody wants your dildos and full size cardboard cutout of putin that you attach your dildo to

Fine, you’re cut out then. Nothing for you.

Surprised no one here asked if they can have your stuff.

[ - ] TheOriginal1Icemonkey [op] 1 point 7 monthsSep 12, 2023 01:08:35 ago (+1/-0)

Ha! No shit, eh? Didn’t even think about that. Everyone here is either of high integrity or asleep at the wheel!⚡️⚡️

It's hard stuff to think about but for me the most difficult procedural aspect of family passing wasn't the funeral itself, but seeing the fuckers squabbling over their belongings.

This is a very good move to make.

You know, I’ve heard the horror stories about that kind of thing. When someone important dies you quickly find out who and what everyone concerned is. It’s really sad to be honest. I’ve never inherited any great sum of anything, so I’ve not been on that end of things. I also know that once I’ve dead and gone, my stuff doesn’t matter, to me anyway, but I don’t want it to be a pain in the ass for the people I want to have it.

Oh it's not even over great sums. I've had relatives who were wealthy who still wanted to argue and pick about the will and what goes where. People just get very petty after the fact. As long as everything is outlined clear you shouldn't have any problems

I’ve seen probate take five years. Absolutely create a trust.

“debt free”

Always lived by this.

One buddy of mine finally realized recently what I was doing. He just thought I was being a cheap fuck.

Some people just don't give a dang.
I've seen people going through someone's stuff when they ain't even cold yet!
I was at the hospital once with folks who had just lost a parent. Two of the "children" of the old dead dude were not there. I found out later that those two were at their dad's house taking the guns that they wanted, before any of the others got them.
Turds the both of them!

If your employer offers legal insurance it should cover creating a revocable trust. You can sign up for the insurance and then cancel after you set up the trust. Saves thousands of dollars.

I’m self employed.

[ - ] ReturnOfTheGoats 1 point 7 monthsSep 11, 2023 18:24:27 ago (+1/-0)

Yeah, it was more of a general statement to let everyone know.

[ - ] TheOriginal1Icemonkey [op] 1 point 7 monthsSep 11, 2023 21:33:20 ago (+1/-0)

That’s cool. People need to know their options and availability for help with these things. Thank you.

O e clever addition is

"If any of the beneficiaries of this will challenge the will they get nothing."

Gotta do what's right by you, and only you know what that really is. Have fun with that shit, though. You only get to bequeath people dumb shit once. If you have anything that's been a particularly large pain in the ass, make sure it goes to some dickhead that deserves it. Who knows, it could be your final chance to say "go fuck yourself"

Remember this is always in the cards

This is a very good idea. A revocable living trust will help your estate avoid probate. It's expensive, but it removes one source of worry about your estate.

[ - ] TheOriginal1Icemonkey [op] 2 points 7 monthsSep 10, 2023 20:09:34 ago (+2/-0)

You know, it’s really not that expensive. Up front it’s like $5,500, and this particular attorney, who specializes in this stuff, sets you up to do a review every three years or whenever something changes. That’s where they make money, reviewing shit every three years. You know how they go, $20 per page of shit they read, fax, file, send, whatever.
Its pennies well spent to secure everything.

I had a Special Needs Trust set up with an attorney for $3,000. My wife is disabled and on Medicare and Medical and lives in an assisted living facility. In case I kick off before her (which is likely), I wanted her to have the estate intact and leave her with a legal representative who would take care of the estate -- which isn't a lot, but it is a house with a lot of equity and a 401k that's not chump change. She's completely incompetent to deal with this herself, so I wrote that into the Trust.

I think I need to go through it again to remove some people who don't need to be beneficiaries of this in case she dies. I thought the Trust was expensive, but from what you said, I think my estate planning was very affordable for my circumstances, especially since the attorney is well regarded.

Your post is well taken and from my perspective very appreciated.

There you go. Operate in a trust. Some of the more affluent individuals I've interacted with utilize trusts... like a certain Mott heiress. (Ever heard of Mott's applesauce?)

[ - ] MaryXmas 1 point 7 monthsSep 10, 2023 19:09:19 ago (+1/-0)

I got diddled by the heiress of segrams...

[ - ] Special_Prosecutor 1 point 7 monthsSep 10, 2023 21:07:19 ago (+1/-0)

What are you then, like 12 years old?

[ - ] MaryXmas 2 points 7 monthsSep 10, 2023 22:25:00 ago (+2/-0)

Yes. I am a 12 year old. Hear that Paul Neri?!

[ - ] paul_neri 1 point 7 monthsSep 11, 2023 06:14:40 ago (+1/-0)

Unfair, dude, my account was hijacked.Could have happened to anyone, including...you!

Crazy that a product like applesauce can create heiresses.
