France has an inquisitorial justice system, unlike our adversarial one, therefore, I doubt any evidence gathered of a non-related offense can't be dismissed if the original suspicion of crime is proven false.
France is officially going to do what's going on anyway although in a round about manner? Need I remind you of five eyes? America can't spy on its citizens so it has one of its partners do it indirectly. Random cop sends a request to an ISP or phone company and some leftist at the company agrees to comply without a warrant? Look at the whole "swatting" phenomenon, someone make a call to a local P.D. making a claim that they have hostages and a weapon or whatever checks the required boxes and suddenly the police become their tool to assault their target at a cost of a few minutes of time and some level of knowledge on how to make a phone call without being located. Do you think the cops want to kick in the wrong door? Do you think the cops want to kill innocent people? Do you think the cops want to kill innocent dogs? (okay that was a joke as many of them seem to enjoy inflicting emotional distress when they know there are no repercussions in this life although I assure you they will stand judgement) Do you think the cops want to be made to look like fools and bad guys? Do you think the cops want to risk kicking in the wrong door and having it be an innocent armed person who responds appropriately to their home being invaded? That's what these things are, invasions and trespasses be it into your home or into your private papers (emails private messages and so on in electronic terms) and performing these types of trespasses needs to be taken seriously because there is a God and there will be judgement.
