Judges in general are the biggest assholes in the courtroom. I'd sooner deal with a prosecutor directly. At least they have some incentive to clear the docket.

Basically they are arbitrary and convinced of their own righteousness. That could go your way, but it also could not. And like I said they're lawyer assholes, so odds are they aren't gonna like you. A lot of them are elected, and the rest are political appointments. In a blue state, they are 100% democrat.

I do agree that I'd rather have a jury convict but you don't really want a sentencing jury. Judges understand that you are supposed to go multiple under maximum sentencing because the whole point of the maximum sentencing is for handing down a stiff judgement on the worst case you saw that year. Juries see, oh, he had three small bags of weed in three different locations in his car, that's three counts of possession. Maximum sentence is 7 years. We could give him 21 years. We'll be really nice and give him 8. We are being so nice. When a judge would understand that the norm would be 9 months.

Judges understand that legislators put big numbers in their bills for maximum sentences to grand stand how tough on crime they are. Even Biden bragged out 30 year maximum sentences for a tiny rock of crack. Judges get that maximum just means maximum while juries treat maximum like the law's suggestion.

I think the defense should be able to pick both.
