If the guy says anything to him, he strengthens their case against him.

The case is weak IMO. According to the article, he doesn’t say that he will shoot Chitwood, he is just espousing a theoretical course of action, but not saying he would follow it and doesn’t seem to be coaxing anyone else to do it.
