If the punishment is a fine, then it's purpose is to control poor people. Rich people just do what they want and pay the fine. How many stories have there been of big banks or corps doing something 'illegal' and pay a huge fine that is much smaller than what they scammed people out of.

Why not just have the fines go to the victim in excess of the harm?

A crime punishable by fine without a victim is just a tax.
