Reading the arguments and the rationale for the judges decision.

From a purely constitutional/logical/philosophical/legal perspective, I find it hard to agree with the statement that cheese pizza is not protected under a policy of full free speech, if a video of a robbery or a murder is legal to possess, view, or distribute (commercially or not), then it follows that the recording of any crime should be permitted under the principle of equal protections, in all cases the videos were created using the harm done to another individual, in all cases the viewers of such materials tend to find it gratifying, in all cases the videos could be seen as promoting the crimes depicted therein, and certainly there are communities of dangerous individuals that form around the materials in question, there's literally nothing that could be used to make a special exception for this particular kind of material.

keep in mind that just because I can remove my emotions from my reasoning doesn't mean I don't feel them regardless, I'm a big proponent of acting on instinct, intuition, emotion, your gut, whatever else you call it, I think it's a very good basis for decision making, if not one of the best, pedophiles are disgusting monsters who should be given the death penalty, that is my real position on this, but going by the basis of the constitution and American legal system, these guys should've won their case to make materials that record or depict children being involved in sexual activity legal under the first amendment.

So the problem isn't with the claimants, but with the US law itself, fact is that the constitution does allow for this kind of stuff to be legal for all purposes, the constitution is what is flawed here.

In America they do not actually have free speech, which might be a good thing in some cases, as I don't think free speech is a good policy to have, anyway, look at how the incomplete version of "freedom of expression" has utterly ruined the country:

Propaganda dominant in every form of media, nonstop indoctrination in every bit of "education", and widespread degeneracy (and promotion thereof) which has gotten to such an extent of repulsiveness that even videos of children being raped would not add all that much to it.

Like democracy, free speech is one of those things that sounds nice, something everyone wants, until you actually consider the implications or get a look at the results.

Perhaps we need to reconsider the principles we hold as being good rather than pretending to believe in these principles and then forming these special case exceptions for when those principles allow for particularly undesirable results.

It's not just the first amendment, we don't really have any of the constitutional freedoms promised in America, not really, every one of them has been thoroughly violated, as the US system is full of exceptions that abridge and infringe upon them, sometimes because of the realization that the effects of these freedoms or rights allow for things that just don't sit right with decent folk, and in other cases it's for more political reasons.

Perhaps that's a good thing; the constitution and bill of rights was made by hellfire club members and freemasons, surely they wouldn't mind there being videos of child rape floating around, they themselves had raped children and considered it perfectly fine.

The kind of society we need is not the sort that these men would have envisioned, a modern day conservative or white right member would see most of the opinions held by these forefathers as being deeply repulsive.

It could be their attitudes towards the treatment of children, or of their support for drug use, or of their endorsement of slavery (including that of whites), or of their many other opinions, including their attitudes towards different ethnicities (including white ones).

Basically, they were kinda good in some ways, but in others they were very much not.

Americans will have a hard time hearing this about the heroes that are their nation's founders.
