Minneapolis teachers union agreement stipulates White teachers be laid off first, regardless of seniority

An agreement between the Minneapolis Teachers Union and the school district states that White teachers will be laid off before teachers of color, regardless of their seniority.

The agreement, which was reached to end a two-week teacher strike last spring, says that starting this school year, "if excessing a teacher who is a member of a population underrepresented among licensed teachers in the site, the district shall excess the next least senior teacher, who is not a member of an underrepresented population."

I don't know that it ever practically was illegal to discriminate against whites. At the very least, you can just say you're "compensating for past discrimination" and it's perfectly legal. Yes, nominally it is illegal, but paradoxically affirmative action is legal, and I don't see how you can do one without the other.

"Affirmative action" should not be legal. Pure and simple. You don't correct discrimination in the past by discrimination in the present. "Oh, hey, some guy in the past got screwed over, so I'm gonna screw you over now to correct for it."

Just because the union has endorsed racist hiring practices doesn't mean they aren't a violation of the law. I don't even think the union could be sued for it, but the school districts can, and the judge may not be very sympathetic when their attorneys claim the union said it was okay.
