I was wondering that as well, and looked into it. Illinois Learning Standards has SAT scores that must be met. 37.6% wound up in the categories of "Partially Meets Standards" and "Approaching Standards," so failing essentially means not meeting whatever arbitrary score some bureaucrat made up.

The article makes strange reading. Currently grades include non-academic factors. If two students do equally well on the examination, you expect them to get the same grade. That could be awkward. If one of the students wasn't coming to class, but gets the same grade, that makes the teacher appear useless.
Non-academic factors protect against this. They reduce the marks of the student who didn't show up. That hides the uselessness of the teachers. But they are proposing to stop including non-academic factors, giving up their protection. I don't think they have thought everything through.
