I hope this lawyer finds himself in a minor Jeep Wrangler fender bender, where he will surely be ejected into traffic. He’ll sue the guy that laid the road.

This all sounds retarded.

It has to do with "no fault insurance". Anything your car does is your problem. Let's hope this sets a precedent for the better because that's a giant miscarriage of justice.

Yeah. Michigander. Nobody has been happy with these policies. We're paying out the ass, higher than most other states, in premiums that were supposed to be lowered by these changes. The idea was that by capping payouts for auto damage/injuries, and forcing all insurance companies to pay out for their own policy-holders regardless of fault, the pay outs would be more efficient, and premiums should go down.

Of course, that's not what happened. Instead, there are tons of lawsuits over the payout amounts. There's rampant fraud involving faked crashes and healthcare cost claims. All of this has just caused the premiums to skyrocket, and innocent responsible people have to pick up the tab. Not only that, but faultless people who are severely injured by another asshole aren't getting shit in compensation despite paying more into the pool than they used to.

Texas policy at least used to be much better. Almost no matter what happens you get your 40k and then fuck you.

How come people can't understand the concept that if they are so valuable they should insure themselves? If your family needs a million dollars or more on account of you dying that's what life insurance is for. Shit happens, particularly auto accidents, so it's not like this is unusual.

Btw my uncle's job used to be investigating the fuckholes that fake accidents, along with their corrupt doctors, paid off truck drivers, etc. Great job, or at least I thought he was great for doing it.

Only reasonable thing to do is be the one in the driver seat while it's at the dealership. "Nope, I'm going to operate the vehicle or you aren't repairing it."

Seems like the kind of frivolous suit that would likely be dismissed with prejudice. The owner had a reasonable expectation to think the person working on his vehicle could drive stick. That doofus mechanic forgot to set the parking brake.

I've basically heard the opposite that if you drop off your car with a valet that they assume all responsibility. Such as when your car gets broken into. Even though they all say they don't.

I mean good luck getting paid, though. Valets aren't generally paying taxes if you know what I mean.

I had a valet run my car into another car, too. Although not as bad. I probably should have sued the guy,

Attorney David Femminineo, who is representing the Hawkins family, says that a legal standard prevents a lawsuit against the dealership. What happened at the dealership involved two employees, and the standard makes it so that you cannot sue the boss in that situation......

"When you hand your car over to anybody including the valet or the person at the service desk at your local dealership, you better be able to trust that person," said Femminineo, according to Fox 2 Detroit.

The place who hires the guy, trained him (let's be real, no training happens anymore but they SHOULD have trained him), and guarantees the customer their work will be competently done by this guy - is not responsible.

But if you hand your keys to a business so they'll perform a service for you - you are responsible

Though this is maddening, I think this would be exactly the kind of push to shake people out of their comfortable lives to actually do something about the eroding world. So in that way, it's good news?

"So in that way, it's good news?"

If it brings about any real change.

I don't think the businesses should be responsible for the incompetency of employees, even if they had extensive training there will still be countless fuck ups that get hired and all punishing that would do is destroy small business. The guy who hired the shop is of course not at fault either, this is purely an affair between two employees.

[ - ] giantprick 0 points 3 yearsMay 25, 2022 16:33:25 ago (+0/-0)

The business chose to make an arrangement with that man. If they didn't vet him they share responsibility for promoting him as an agent of their operations

Don't corporation simp. They aren't looking out for you, only their profits

Mechanic can't drive stick.
No business being a mechanic at all.

Sucked in for owning a jeep.
