There are multiple levels of "is this retarded" that such an effort would have to get through.

1) Being brought to the court.
2) The judge thinking it's sane enough to proceed.
3) Actually proving the case to judge or jury.
4) Appeals courts.
5) SCOTUS.

While you might find enough along the way who politically motivated to keep illegal gun laws on the books or allow for discrimination against whites, they're rarely pants on head retarded enough that anything like this would even make it past step 2 or 3.
