Suing is the future of criminal law. Have you noticed "civil penalities" being threatened by federal agencies? A civil penalty is something you pay when you e.g. run over a fire hydrant and the city sues you for damages. But now they're used by the TSA to enforce mask compliance and behavior in the security line. The neat thing about damages is ex-post-facto doesn't apply. You can damage the government's efforts taking up personal time or requiring increased security costs without ever breaking a law. None of the protections such as cruel/unusual punishment, jury, or guilt beyond reasonable doubt apply. It's a civil suit by the government against you. Letting favorite citizens sue undesirables is just an extension of the above theme. It's possible that in the future you'll be sued by a minority for racial defamation. This wouldn't be a hate crime or even a crime at all. You could burn your own gay flag in your own back yard and get sued for damages if the court can be convinced damage was done.
