You are waking a man from sleep by screaming through the door twice before ramming it open, as a flashbang grenade is simultaneously chucked through his window. Anyone could reasonably assume they were in danger in that context, and respond accordingly. So the police enter waiting for such a response as a justification for shoot-to-kill.

It would be like approaching someone from behind with your gun drawn, kicking them in the back of the knee causing them to collapse, and then shooting that person in the head if they swung at you while falling.

So the tactical argument has to be that, if an alleged suspect is considered dangerous, they have to act quickly so that this person cannot escape or get hunkered in and possibly become a lethal threat to responding officers when the door is finally rammed. That favors a sudden act on the part of police.

To me, this is an issue of the law favoring the rights of the accused. Law shouldn't favor the rights of cops to be tactically efficient over the possibility of harming innocent people.

If they were concerned about an escape attempt, then you surround the building. There is no reason why they are justified with the no-knock and not giving someone reasonable time - at 5 fucking a.m. - to gather their wits and orient themselves. If the question is whether or not the suspect is awake and possibly dangerous, then there is technology that would make it possible to gather whether activity was going on inside. I'm sure some kind of infrared or audio tech could be used in such cases to determine whether there is activity taking place inside.

This shit is just brute force clumsiness that is totally numb to the fact that surprise ambushing someone in the dead of night is likely to get a defensive response even from the innocent.
