There’s two potential charges here: burglary and shoplifting. Both can be proven here and it’s up to the DA how it’s charged.

Burglary is the willful entry into and remaining in any structure with the INTENT to commit a crime.

Shoplifting is the ATTEMPT to defraud a shopkeeper permanently of property.

The former can be proven by incriminating statements, lack of proof of payment, etc.

The latter can be proven by the deliberate travel past all points of payment and (in this case) furtive attempt to evade detection.
