If he's wearing the version with the three arrows then that's not subtle "nod nod wink wink" dog whistling. That's a public employee outright declaring allegiance to a commie terrorist group.

If he's wearing the normal version from star wars then it's hard to attack: plausible deniability.

I don't think so, he's a prosecutor on tv. He should be expected to do due diligence and be responsible for his actions and attire. I would look to see if he wears it regularly and when he started wearing pins. He should be impeccably impartial.

The way they used to be in most countries: Privately. The injured party or their family prosecutes. Public prosecution tends to be something that emerges after a nation is conquered (to justify fines and cement their legitimacy). In some other countries it's been justified on the basis of social justice, but I think you can see how well that's working out.

Technically private prosecution of criminal cases is possible in a lot of countries but virtually no one does and most aren't aware it's an option.

The judge should dismiss all charges with prejudice.
