I hate to say it, but the issue in this particular case is disparity of force. Not only was the cop old, but obviously well past retirement age. Stick or no, even just empty hand attacks could've merited a lethal response.

If the cop was about 30 years younger and 150lbs lighter, the incident almost certainly wouldn't have ended this way.
