Man I'm tired of hearing 'X infringes on our rights, but we'll ultimately not do anything about it!'
The Constitution is literally a contract between the Government and The People. When the Government breaks the contract, it's up to The People to rectify/remedy the situation--- up-to and including toppling the Government.
But until The People stop being fucking useless clowns, their rights will continue to be infringed upon indefinitely and they're getting the exact government they deserve.
