Under Idaho law, a citizen may arrest another: 2. When the person arrested has committed a felony, although not in his presence.
Holy fucking shit, why the fuck aren’t we arresting literally every goddamn government official ON OUR OWN, then?
3. When a felony has been in fact committed, and he has reasonable cause for believing the person arrested to have committed it.
ON. OUR. FUCKING. OWN. We don’t even need reasonable cause because WE HAVE DOCUMENTED EVIDENCE in hundreds of cases.
This pisses me the fuck off. I thought citizen’s arrest laws were far more restrictive than this, and that's why everyone was terrified to use them.
Unless an exception applies, “[t]he person making the arrest must inform the person to be arrested of the intention to arrest him, of the cause of the arrest, and the authority to make it . . . .”
That really seems easy enough.
The private person making the citizen’s arrest may summon others—including the police
Which means that the others DON’T HAVE TO BE police. Which means we can get a goddamn posse together ALL ON OUR FUCKING OWN.
Once a private person makes a citizen’s arrest, he must act without delay to bring the arrestee before a magistrate or to deliver the arrestee to a peace officer.
Easy enough. Sure, the police might immediately let him go, but that’s when you arrest the police officer, too.
