The context: In a pretrial hearing, the judge ruled that Binger could not raise statements Kyle made weeks before the shooting as proof of Kyle's propensity to want to shoot others (as Binger wanted to argue).

Kyle was with friends in a car and observing what looked like shoplifting going on in a CVS. Kyle said something like he wished he could shoot the shoplifters with his AR. He did not have his AR on him at the time. What Kyle did instead was call the police on the shoplifters.

Binger was trying to argue that Kyle's statement showed his propensity for wanting to shoot people for property crimes. The judge ruled that no, he could not bring up the CVS statement because it did not show propensity as far as his state of mind on August 25th was concerned.

Sneaky Binger tried to bring it up in court anyway (a huge no-no). Hence, the reason why the judge was so angry.

And that was just one of the times the judge lashed out at Binger today. The other time was when Binger was twice accused Kyle's silence (his 5th Amendment right) somehow alluded to guilt.
