Under the Publication Approval of the guide it states several times that these are recommendations. While they can be used as evidence for law, it is not of itself law.
How do you think the government is getting away with all this illegal bullshit? It is not holding itself accountable to direct law, it is using the loose fitting wording of unspecific law to say it has a right, because it says so. Even though actual law say it can not.
