You always have to punish in the dimension they showed they care about. Here is the problem with deportation to their own country or jail time. If you deport them back to their homeland that isn't a punishment. That's like if I were a shoe thief and was told if they catch me I'll have to put the shoes back. Worst case I'm back where I started so why wouldn't I try?
The problem with jail time is some of these people are trying to skip out on jail time back home. If you give them jail time in the US you are still rewarding illegal migration.
Here is why Haiti makes sense. They showed they want to live in a better place. This is something we know is true for all migrants. So the quality of place they live is what they care about and what you have to punish. Send them to a worse place.
It is necessary to punish people who do not self deport because it is not financially feasible for us to deport even 10% with our current procedures. You have to produce the incentives for them to want to pay for their own way out. Nothing else will work.
