On point two, its a "double crime" as in whatever he did would have bee considered a crime. If he used personal funds to shut her up, than he would have broken some disclosure law for campaigning. And if he uses campaign funds, he would be in trouble for illegal use of funds. Both ways, they would have tried him for some stupid technicality.
