In this case though, all they need to do is ask "are you a resident of the united states or do you have a valid visa?". If they say no, then off they go, due process. If they say yes, then they get a court date and a lawyer and if they lied about that, the get perjury and deported.
Exactly so. The Constitution doesn't apply to non-citizens. They have no guarantees of legal protection.
