Under the existing laws, he would get convicted. But in a just society, this would fall entirely under self defense. You can't initiate a violent robbery and then cry when the victim wins.
"But I don't want to play anymore" is not something the victim should have to consider. He is still a threat, he could still have a gun, and why is the onus on the victim to psychically intuit exactly when the robber's intentions have changed from 'going to rob and kill you' to 'please dont hurt me', and why should you trust them?
The solution is simple. Don't rob people. Once you do initiate a robbery, you have forfeited your right to life, and no one should be prosecuted for executing you in any fashion they see fit at the time.
